કર્ણાટક હાઈકોર્ટે કહ્યું- સ્ટુડન્ટ્સે સ્કૂલ યુનિફોર્મ જ પહેરવો પડશે, હિજાબ ઈસ્લામનો અનિવાર્ય હિસ્સો નથી
કર્ણાટકમાં ચાલી રહેલા હિજાબ વિવાદ પર આજે હોઈકોર્ટે ચૂકાદો આપ્યો છે. હાઈકોર્ટની ત્રણ જજની બેન્ચે કહ્યું છે કે હિજાબ ઈસ્લામનો અનિવાર્ય હિસ્સો નથી. આ સાથે જ હાઈકોર્ટે સ્કૂલ-કોલેજમાં હિજાબ પહેરવાથી ઈન્કાર કર્યો છે. હાઈકોર્ટે કર્ણાટક સરકારના 5 ફેબ્રુઆરીના આદેશને ફગાવવાનો પણ ઈન્કાર કર્યો હતો. ઉલ્લેખનીય છે કે સરકારના આ આદેશમાં સ્કૂલ યુનિફોર્મને જરૂરી ગણાવવામાં આવ્યો હતો.
મંગળવારે કર્ણાટક હાઈકોર્ટમાં ચુકાદો સંભળાવતા પહેલા ચીફ જસ્ટિસ રિતુરાજ અવસ્થીએ કહ્યું કે આ મામલામાં બે સવાલ પર ધ્યાન આપવાનું છે. પ્રથમ વાત એ છે કે શું હિજાબ પહેરવો તે આર્ટિકલ 25 અંતર્ગત ધાર્મિક આઝાદીના અધિકારમાં આવે છે. બીજો મુદ્દો એ કે શું સ્કૂલ યુનિફોર્મ પહેરવો તે આઝાદીનો ભંગ છે. તે પછી હાઈકોર્ટે શૈક્ષણિક સંસ્થાઓમાં હિજાબ પરના પ્રતિબંધને યોગ્ય ઠેરવ્યો છે.
હિજાબ વિવાદ પર કર્ણાટક હાઈકોર્ટના ચૂકાદા પહેલા ચીફ જસ્ટિસ રિતુરાજ અવસ્થીના ઘરની બહાર સુરક્ષા વધારવામાં આવી હતી. બેંગલુરુ સહિત કર્ણાટકના પાંચ જિલ્લાઓમાં કલમ 144 લાગુ કરીને તમામ પ્રકારના સરઘસ અને લોકોના ભેગા થવા પર પ્રતિબંધ લગાવવામાં આવ્યો હતો. બીજી તરફ સમગ્ર કર્ણાટકમાં કલમ 144 લાગુ કરીને સ્કૂલ-કોલેજને બંધ કરવામાં આવી હતી.
હાઈકોર્ટમાં ચીફ જસ્ટિસ ઋતુરાજ અવસ્થી, જસ્ટિસ કૃષ્ણા એસ. દીક્ષિત અને જસ્ટિસ ખાજી જયબુન્નેસા મોહિઉદ્દીનની બેન્ચે 11 દિવસ સુધી આ મામલે સતત સુનાવણી કરી હતી.હાઈકોર્ટમાં સુનાવણી દરમિયાન અરજદારના વકીલે કહ્યું હતું કે ઈસ્લામમાં છોકરીઓને માથું ઢાંકીને રહેવા માટે કહેવામાં આવ્યું છે. એવામાં શાળા અને કોલેજોમાં હિજાબ પરપ્રતિબંધ મૂકતો ડ્રેસ કોડ સંપૂર્ણપણે ખોટો છે. સરકાર વતી રાજ્યના એડવોકેટ જનરલ (AG) પ્રભુલિંગ નવદગીએ બેન્ચ સમક્ષ આ દલીલ કરી હતી કેહિજાબ એ ઇસ્લામની ફરજિયાત ધાર્મિક પ્રથા નથી.
